Terms and conditions
Last updated: 13 October 2026
These terms and conditions govern the use of the online service ProCMR (the “Service”), which allows you to fill in, save, copy and print international CMR consignment notes. The Service is provided by MOUTARDI SRL, tax ID RO18215584, Trade Register no. J11/1087/2005, registered office at Str. Trandafirilor no. 11, Băile Herculane, Caraș-Severin County, Romania, e-mail contact@moutardi.ro, telephone +40 732 331 301 (the “Provider”). By creating an account or using the Service you confirm that you have read and accept these terms.
1. Description of the Service
The Service provides an online editor for the CMR document, saving of frequently used data (companies, drivers, vehicles) for automatic completion, storage of the documents you create, and printing them (copies 1–3) from the browser, including as a PDF file. The Service is a drafting tool; it is not legal, customs or transport advice.
2. User account
- To use the Service you must create an account with a valid e-mail address and a password. You are responsible for keeping your password confidential and for all activity in your account.
- The information provided at registration must be accurate and kept up to date. An account belongs to a single person or company.
- We reserve the right to limit or suspend accounts created abusively (for example, multiple accounts created to repeatedly obtain free documents) or used contrary to these terms.
- You may request deletion of your account at any time, at the e-mail address above.
3. Free test documents
Each new account receives a limited number of free CMR documents for testing purposes (currently 10). Documents created from free units cannot be modified after saving; they can be copied, and the copy uses one unit. The Provider may change at any time the number of free documents offered to new accounts, without affecting accounts already created.
4. Units and prices
- Each CMR document or transport order created or copied uses one unit from the matching counter (CMR or transport orders). If you have purchased and uploaded a logo, watermark or signature, each document also uses one unit of each. Free units are used first.
- Units are purchased per item (CMR, transport orders, logo, watermark, signature) in packs of 25, 50, 100, 500, 1,000, 5,000 or 10,000. The full pack, with all items selected, includes double units of logo, watermark and signature. The minimum payment is 3 EUR. The applicable price is the one shown in the application at the time of the order.
- Prices are expressed in EUR. For users’ convenience, the application may also show an indicative amount in the local currency; this amount is for information only, and payment is processed in the currency indicated when the order is completed.
- Purchased units never expire. They are personal and cannot be transferred or redeemed for money.
- The Provider may change prices for future orders. Orders already paid are not affected.
5. Payment
Payments are made online through the payment processor Stripe. Card details are entered directly on the secure Stripe page; the Provider does not receive or store full card details. Units are added to your account after Stripe confirms the payment. If you have paid and the units do not appear in your account, you can write to us at the contact address, with the order details.
6. Right of withdrawal and refunds
Units are digital content supplied immediately after payment is confirmed. If you are a consumer, by completing the order you expressly agree that supply begins immediately and you acknowledge that, once supply begins (units added to your account), you lose the 14-day right of withdrawal, in accordance with Article 16(m) of Romanian Government Emergency Ordinance (O.U.G.) no. 34/2014. Units already used are not refunded. For payments made in error or charged twice, we will refund the amounts accordingly, at your request.
7. Responsibility for the content of documents
- You are solely responsible for the accuracy and legality of the data entered in documents (sender, consignee, carrier, goods, weights, instructions, etc.) and for compliance with the CMR Convention, customs legislation and any other regulation applicable to your transport.
- The Service does not check the content of documents and does not guarantee that they will be accepted by authorities, carriers or business partners.
- You may not use the Service for false, misleading or unlawful documents, nor enter data of persons without having the right to process it.
8. Personal data
The processing of personal data is described in the Privacy Policy, and the use of cookies in the Cookie Policy. To the extent that you enter personal data of third parties into the Service (for example drivers, contact persons), you are the controller of that data and the Provider acts as processor, processing the data exclusively to provide the Service, according to your instructions and the security measures described in the policy.
9. Availability and changes to the Service
We make reasonable efforts to keep the Service available at all times, but we do not guarantee uninterrupted operation or the absence of errors. There may be interruptions for maintenance or for reasons beyond our control. We may add, change or withdraw features, while respecting units already purchased. We recommend that you keep copies (printout or PDF) of important documents.
10. Intellectual property
The application, its design, texts and the ProCMR brand belong to the Provider or its licensors. You receive a limited, non-exclusive and non-transferable right to use the Service for your business. The documents you create and the data you enter remain yours.
11. Limitation of liability
To the extent permitted by law, the Provider is not liable for indirect losses, lost profits, transport delays, fines or penalties resulting from the content of documents or from the use of, or inability to use, the Service. The Provider’s total liability to you, for any cause, is limited to the amount you paid for units in the last 12 months. Nothing in these terms excludes liability that cannot be excluded by law (for example, for fraud or gross negligence).
12. Termination
You may stop using the Service at any time and may request deletion of your account. The Provider may suspend or close an account that breaches these terms, with prior notice where possible. If an account is closed because of the user’s fault, remaining units are not refunded.
13. Changes to the terms
We may update these terms; the version in force is the one published on this page, with the date of the last update. For important changes we will notify you by e-mail or in the application. Continuing to use the Service after the changes take effect means you accept them.
14. Governing law and dispute resolution
These terms are governed by Romanian law. Any dispute will be resolved amicably or, failing that, by the competent courts of Romania. If you are a consumer, you have the right to use alternative dispute resolution mechanisms (ANPC – anpc.ro) and the European online dispute resolution platform (ec.europa.eu/consumers/odr).
